Who Is Responsible for Drainage Easement Maintenance?

The City of Gunter has determined that the maintenance of drainage easements located on private property, including but not limited to the removal of shrubs, brush, trees, trash, debris, and silt, is the responsibility of the owner of the property.  However, The Woods subdivision HOA documents specifically authorize the HOA to perform maintenance in drainage areas.  It is unknown to the city whether the HOA documents for other subdivisions in the city contain similar provisions.  

The city is aware of other private property owners in the city who have incurred expenses in maintaining drainage easement, appreciates such owners caring for their property, and encourages other residents to do the same in coordination with their HOA, if applicable.
